MASTER TERMS, POLICIES & LEGAL AGREEMENT
Parijat Blooms
1. LEGAL ACCEPTANCE & BINDING NATURE
This Master Legal Agreement ("Agreement") consolidates and supersedes all prior policies including Terms & Conditions, Privacy Policy, Shipping Policy, Refund Policy, and Product Usage Policy.
By accessing, purchasing, or using our services, you:
- Agree to be legally bound by this Agreement
- Acknowledge all disclaimers, limitations, and obligations
- Confirm informed and voluntary acceptance
This Agreement shall be read as a unified legal document, and all clauses are cross-referenced and interdependent.
2. DEFINITIONS
Defined terms used in this Agreement are as specified in the Terms & Conditions. All such definitions apply consistently across this Agreement.
3. ELIGIBILITY & USER REPRESENTATIONS
- You represent and warrant that you are legally competent under Indian law
- You represent that all information provided is accurate (subject to Clause 11)
- You agree to comply with all applicable laws and this Agreement
4. SERVICES, ORDERS & ACCEPTANCE
All orders are subject to acceptance, availability, and verification. We reserve absolute rights to cancel or refuse orders, request KYC/verification, and limit quantities. These rights are subject to Clause 15 (Fraud Prevention).
5. PRICING & PAYMENTS
- Prices are quoted in INR and are subject to change
- Payment is required prior to processing
- Charges such as shipping or COD are non-refundable

6. SHIPPING, DELIVERY & RISK TRANSFER
- Delivery timelines are indicative only
- Risk transfers upon dispatch to the courier
- No liability after handover to courier
User obligations include providing accurate address and availability for delivery. (Subject to Clause 13 – Limitation of Liability)
7. CANCELLATION, RETURNS & REFUNDS (STRICT)
- No monetary refunds under any circumstances
- Only replacement or store credit may be provided at our sole discretion
Conditions:
- Cancellation only before dispatch
- No returns accepted for hygiene reasons
- Claims must be raised within 24 hours and include mandatory unboxing proof
We reserve absolute discretion over all claims. (Subject to Clause 13 & Clause 15)
8. PRODUCT USAGE & SAFETY (STRICT)
Patch test is mandatory prior to first use. Failure to perform a patch test constitutes user negligence.
- Products are for external use only
- Products are non-medicinal and not intended to diagnose, treat, cure, or prevent disease
- Natural variations (color, aroma, texture) are not defects

9. STORAGE, SPOILAGE & USER LIABILITY
Improper storage or handling that results in spoilage, contamination, or degradation shall be deemed user liability. No replacement, refund, or liability shall arise where damage is due to improper storage or handling.
10. MEDICAL & REGULATORY DISCLAIMER
Products are cosmetic in nature. We do not provide medical advice and do not guarantee results. Users should consult appropriate medical professionals where required.
11. PRIVACY & DATA PROTECTION
We collect and process personal data, transaction data, and technical data for purposes including fulfillment, support, and analytics. Data may be shared with logistics partners, vendors, and legal authorities where required. We do not sell personal data. (Subject to Clause 13 – Limitation of Liability)
12. THIRD-PARTY SERVICES DISCLAIMER
We are not responsible for the policies or failures of third-party payment gateways, courier partners, or external websites. Interaction with such services is at your own risk.
13. LIMITATION OF LIABILITY (STRICT – CORE CLAUSE)
To the maximum extent permitted by law, Parijat Blooms shall not be liable for indirect or consequential damages, allergies, misuse, negligence, delivery delays, data breaches, or technical failures.
Maximum liability: the lower of the product value or INR 1,000. This clause overrides conflicting interpretations.
14. INDEMNITY
You agree to indemnify and hold harmless Parijat Blooms, its officers, employees, and agents from any claims arising from misuse of products/services, violation of this Agreement, or third-party claims.
15. FRAUD PREVENTION & ENFORCEMENT
We reserve absolute rights to cancel suspicious orders, block users, and initiate legal proceedings. Our decisions in fraud prevention and enforcement are final and binding.
16. FORCE MAJEURE
We shall not be liable for events beyond our reasonable control including natural disasters, government actions, strikes, or supply chain disruptions.
17. DATA RETENTION & USER RIGHTS
We retain data as required for business, compliance, and dispute resolution. Users may exercise applicable data rights subject to legal limitations.
18. CHILDREN POLICY
Our services are not intended for users under 18. If you are under 18, you must obtain parental or guardian consent before using our services.
19. INTELLECTUAL PROPERTY RIGHTS
All content, branding, and materials on the site are the exclusive property of Parijat Blooms.
IP INFRINGEMENT REPORTING
To report infringement, email: care@parijatblooms.in. Include proof of ownership and a description of the violation. We reserve the right to remove or restrict content where appropriate.
20. TERMINATION
We may suspend or terminate access to services without notice. No liability shall arise from such termination.
21. GOVERNING LAW
This Agreement and any disputes arising shall be governed by the laws of India.
22. DISPUTE RESOLUTION (ARBITRATION CLAUSE)
All disputes shall be resolved through binding arbitration:
- Seat: Mumbai, India
- Language: English
- Single arbitrator appointed by the Company
Courts in Mumbai shall have jurisdiction only for enforcement of arbitration awards.
23. CLASS ACTION WAIVER
You agree that disputes shall be resolved individually and that class or representative actions are not permitted.

These timelines are in accordance with Consumer Protection (E-Commerce) Rules, 2020.
25. AMENDMENTS
We may modify this Agreement at any time. Changes will be effective upon posting. Continued use of our services constitutes acceptance of the updated Agreement.
26. ENTIRE AGREEMENT
This Agreement supersedes and consolidates all prior documents and constitutes the entire agreement between you and Parijat Blooms.
